1. Introduction & Acceptance of Terms

Welcome to BLIVERR. These Terms of Service ("Terms") govern your access to and use of the BLIVERR website, platform, and music distribution services (collectively, the "Services"). By registering for an account, submitting an application, or uploading content to our platform, you agree to be bound by these Terms.

If you are agreeing to these Terms on behalf of a band, record label, or other corporate entity, you represent and warrant that you have the legal authority to bind that entity to these Terms.

2. Your Rights and Ownership

You retain 100% ownership of your intellectual property. BLIVERR does not claim any ownership rights to the sound recordings, musical compositions, or artwork you upload to the Services.

By using our Services, you grant BLIVERR a non-exclusive, worldwide, royalty-free license to distribute, reproduce, publicly perform, publicly display, and authorize digital service providers (DSPs) to exploit your content solely for the purpose of providing the distribution services you requested.

3. Content Guidelines and Anti-Piracy

You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to distribute the content you upload. You strictly agree not to upload:

• Copyrighted material belonging to third parties without explicit legal authorization.
• Covers or remixes without securing the appropriate mechanical licenses.
• Hate speech, discriminatory content, or content promoting illegal activities.
• "Fake streams" or artificial engagement mechanisms designed to manipulate royalty payouts.

BLIVERR enforces a strict zero-tolerance policy for copyright infringement and streaming fraud. Violations will result in immediate account termination, takedown of all content, and forfeiture of associated royalties.

4. Royalties and Payouts

BLIVERR collects royalties and net revenue generated from the exploitation of your content on DSPs. We will credit your BLIVERR account with 80% of the net revenue received from DSPs, less any applicable distribution fees, taxes, or banking fees as outlined in your specific pricing plan.

Payouts can be requested once your account balance reaches the minimum threshold of $50.00 USD. Payment processing times vary depending on your selected payout method and banking institution.

5. Takedowns and Account Termination

You may request a takedown of your content at any time through the BLIVERR dashboard. Please note that it may take up to 7 business days for all DSPs to process the removal request and for the content to disappear from their storefronts.

BLIVERR reserves the right to suspend or terminate your account at our sole discretion, without prior notice, if we suspect you have violated these Terms, engaged in fraudulent activity, or submitted unauthorized materials.

6. Limitation of Liability

To the fullest extent permitted by law, BLIVERR and its affiliates, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services.
